iPhone instalments with MDM, within the law

Selling iPhones on instalments with MDM means the shop keeps title until the customer pays in full, ties each contract to a device, reminds only from 7am to 9pm, applies tiered locks when overdue, and unlocks when the customer pays. Do not use MDM to read messages or to lock a phone that is already paid off. This article sets out the model, Vietnamese law and what the shop must do.

The instalment model with MDM

Selling iPhones on instalments with MDM is not a tracking app on the customer's phone. The shop enrols the device in Apple Business and ABMDM before handover, ties the serial to the contract, then runs reminders and tiered locks when overdue.

The device belongs to the shop until the customer pays in full. That is Civil Code Article 453 on deferred and instalment sales — not a “lock trick”. Operations sit on device financing.

Legal rules the shop must keep

Manage only devices the business owns, or devices with written consent. The instalment contract should include a clause in which the customer consents to device management and to location processing when overdue — the financing page gives the idea, not a lawyer-drafted contract.

Reminders 7am–9pm, named party only. Do not barrage-call, and do not lock a relative's phone.

Location is sensitive personal data (Law 91/2025/QH15, Decree 356/2025/ND-CP). View it only when a contract is overdue or the device is in Lost Mode, and log every access. Security states what is collected.

Before you hand the phone over

Enrol it, Supervised mode, block removal of management. Attach the contract, write a reminder with the shop phone number. Test lock then unlock on one company device.

Hand over the paperwork. Say clearly the shop keeps title until payoff, and a factory reset does not take the device out of the system.

Do not hand over a clean phone and remember MDM later. Once it leaves the shop, you have no remote command channel.

On-time payments and payoff

Reminders on the device and by message in the legal hours. If balance notifications are connected, a VietQR transfer unlocks the device.

Payoff: the device unlocks and leaves management in the financing flow. Check the device itself — no Device Management item, no organisation setup screen — before you treat it as clearance stock.

A paid-off phone that reaches the used market still showing a company screen is how the next buyer thinks it is “MDM-locked”.

Several branches, one contract per device

One device, one contract, one serial. Staff should see only their branch's devices. Do not lock the whole fleet from a shared login with no named owner.

Alerts on SIM change, carrier change, or no contact beyond a set number of days tell the shop the device went quiet. They do not replace tiered locks, and they do not let anyone read what is on the phone.

When the customer is overdue

Do not wipe the phone over a few late days. Use tiered locks: restrict step by step, always leave a way to pay and to call.

Unlock when they pay. Log who sent the command. Trial 14 days, up to five devices. Call 0913 081 986 (8am–9pm).

Frequently asked questions

Who owns an iPhone sold on instalments?

The seller keeps title until the customer pays in full (Civil Code Article 453). MDM ties the contract to the device; after payoff, remove management.

Can we lock a phone the customer has already paid off?

No. A paid-off phone is no longer the shop's property under the contract. Leaving it locked is wrong for the next buyer.

Can we send payment reminders after 9pm?

No. Reminders and overdue locks only from 7am to 9pm, and only to the person named on the contract.

Can MDM read a customer's messages?

No. Apple's protocol does not let a management server read messages, photos or passwords. ABMDM cannot see that data either.

What if the customer changes SIM?

ABMDM can alert on SIM change, carrier change, or no contact beyond a set number of days. You still apply only the contract's lock tiers, in the legal hours.
